I write to you on behalf of the Executive Committee of the Owners Corporation, Strata Plan 91667.
We are obligated to ensure that our building is compliant for the safety and health of residents, in keeping with fire regulations, our building by-laws, local council zoning laws and NSW state laws.
We are furthermore committed to ensuring that Aspire Apartments remains an attractive building, not only increasing in value for its owners, but to provide a quality residential environment for its tenants.
The single most important factor of this is to ensure that we don’t have issues with subleasing and/or overcrowding. Both will simply not be tolerated, with no exceptions.
There are a small number of apartments in Aspire that are currently breaking a range of fire compliance, building, council and state laws.
Sydney City Council will be notified of the specific apartments in the coming days, and an urgent council inspection will be requested. Managing Agents will also be requested to inspect each apartment and report back to the Owners Corporation. Security logs will be analysed, to ensure that any illegally cloned fobs are permanently disabled in the building security access system. Should the Owners Corporation wish to take the matter to the NSW Tribunal, they can impose penalties of up to $5,500 for the first offense and $11,000 for each and every subsequent offense detected within 12 months of the imposition of the earlier penalty.
The offending tenants know who they are, and they are on our radar as the number one priority to sort out in early 2017.
The Executive Committee will have no hesitation in seeking immediate eviction/removal of offending leaseholders, through channels that are available to us. In the past 8 months, 10 separate leaseholders have been removed from the building due to such issues.
If you are housing more than the maximum amount of persons allowed, (2 persons for 1 bed, 4 persons for 2 bed) I STRONGLY suggest that you correct the situation with the highest of priority, and respect the conditions of living in this building. Otherwise I suggest you find another building to live in as soon as possible, that will allow this illegal and dangerous behaviour.
